Benchmark, Partners Capital, Cobalt Funding, Now MD Capital the Names Change but The Crooks Remain the Same

I received this note from someone who tracks the comings and goings of Marcus Davin and his band of thieves.  

Your friends at Benchmark Leasing – sorry, Cobalt Funding, have now changed their name again and moved back to 65 Enterprise.  They are going by MD Capital but with no name on their office J  Just thought you might like to hear the latest!

Marcus Davin and Cobalt Funding

I get calls and emails weekly about Cobalt Funding and Partners Capital Group, and Marcus Davin ... amazing that he still gets away with stealing from small business people.  


Here is my best advice.  


1.  If you are out of state, file a written complaint with the FBI , Fax it to :Agent Paul Bonin  714-245-5394

2. File a complaint with the Orange County Sheriff's Department Phone 714-647-7040

3. File a complaint with the the Better Business Bureau Better Business Bureau    Marcus Davin changed the name of the company from Benchmark to Cobalt .. probably because Benchmark has an F rating ..   and over  80 complaints ... now there is only one complaint on Cobalt and it says that it has been resolved ..

Hard to believe that the person who filed the complaint wrote:  "I have received full refund and am 100% satisfied with Cobalt . Loan did get approved and Cobalt is ready to fund Marcus Davin was a true professional."  

Has this been your experience with Marcus and Cobalt .. Benchmark ... a professional crook maybe ...

It is hard for me to keep up.. But I take ever telephone call from victims and answer every email and there are many. Today I got two.

First was a call from a lady from Ohio who was about to get ripped off by Marcus Davin for about $10,000. The vendor did some checking ... Googled Cobalt Funding read m y blog and hopefully she got to the bank quick enough to stop the transaction .

Marcus Davin and his minions tell customers to fill out the paperwork, prepare a check for first, last and fees, fax both .. And then they take the numbers off the faxed check and take the money... That's it... Then deal changes... And the victim does not get their money back.. That is it hundreds if not thousands of times by now.

Don't worry about a thing. Marcus Davin Et el are alleged crooks.. And they will go to prison when proven guilty in criminal court.

I haven't seen any updates to your site regarding Benchmark Financial. I am in the same Ofice Complex as Marcus and his company. They have definitely changed their name to Cobalt Funding. They moved from 65 Enterprise to 75 Enterprise (the building next door). He has removed all signs for his office as well as his parking space. Just thought I'd update you on this slime.

He can change his location, his name, his hair color ..... But he can't change the fact that he is a crook .... I want to see Marcus in Court ...

Partners Capital - The New Benchmark for Fraud?

I am getting calls from victims who are getting ripped off by one of Marcus Davin's other company's .. .. Partners Capital Funding. They are following up with equipment vendors as well to offer them "kickbacks" for new applications.

Benchmark's Attorneys Want Out!

Brewer and Brewer the attorney for Benchmark in the Quonix Networks, Inc Case has requested to be removed from the case. Imagine that. The motion will be taken up on October 31st.

Meanwhile, I am contacted almost daily by people who have been taken to the cleaners by Marcus Davin and Benchmark.

Another Complaint about Benchmark .. now Cobalt

Here is a short summary of what happened to me, I will be more than happy to send all copies of emails and other documents that I have concerning this matter if needed.

After receiving emails normally every week, from Benchmark , I decided to reply to one. The representative that I dealt with was , Adam DiCosola, and the first email that I answered was one dated 1/20/2011 . I asked him to put together some funding details for a working capital loan/lease in the amount of 25k to 35k. After about a week, I completed the application and forwarded the required documents at the time. In February, he sent me an email, ( also a telephone call ) explaining the loan details, monthly payments and fees. In March , I asked specific questions concerning this matter, and he answered them in an email. I then sent the final signed documents with a check ( approximately $ 1600 ) to cover the 1st, last, and fees.

After he received this , he then said there may be additional fees now. He also said more documents are now needed. I supplied everything that was asked of me, all of the additional requests. In April, he now said that the original terms would have to be now changed, since this funding option was no longer available to me . ( ?????) He said that we now had to make it a collaterized loan. Again, I sent in more documents asked of me. I knew that something was wrong , and refused to send in any additional monies for fees etc.

In May, Mr. DiCosola said that all of his underwriters denied the funding. He then said there may be other options. I said to cancel all of this, and refund to me the money that was promised in our discussions. He said it would probably take a month but I would be receiving a check for my initial down payment minus their small fees.

Since May, I have been told that the accounting department has my file, that most of the employees are on vacation in June and July etc..... every excuse which he could state. I have never received anything back from this company, and now all of my emails and voice messages are being deliberately ignored.

The entire effort is worthwhile because of what happened today. Chris a vendor., was doing some research for his customer. The customer was contemplating a lease from Benchmark.  Chris who is outstanding, Googled Benchmark and it led them to me.  His customer was asked to send $4,000 + for the deal that could be closed by next Wednesday. They needed a faxed copy of the check and signed docs ...today.   

Guess what advice I gave to Chris?  This is an example of excellent customer service!  Makes all effort worthwhile. 

Businesses don't commit crimes, People do.

Hey Ron, if you can please not post my email address but I'm shocked how Benchmark can still operate. I know for a fact that they have only a couple of lenders who will accept applications from them. We had an employee who left our A+ rated BBB company with 10+ years in business, over 2 dozen lending sources, and a solid reputation to go work for Benchmark. He just quit there because of a commission dispute and is now looking for work again. I just can't imagine cold calling businesses and trying to get them to finance with  Benchmark. Sure some business owners are too busy to do a little background search and some are very trusting but the vast majority of business owners will do their due diligence. Benchmark employees must feel some guilt going into work every day. It has to be hard trying to earn a living when your employer's reputation is the worst in the industry plus with only a few lending sources. Many finance companies in Irvine are hiring experienced reps who are good on the phones. You can earn a living being a good person and not screwing businesses. It's a lot easier getting a customer to do business with you when you're an A+ rated BBB company. I feel bad for Benchmark employees. There's a lot more commission funding a $75,000.00 lease than ripping someone off for $1,000.00 and giving more than half to Marcus. Do the right thing.

Another advance rental complaint on Benchmark

 I sent my lease application on 02/08/2011 with the whole information in it; including my SSN, my address and company information. Few days later, i got a phone call from Steve Peeler where said "congratulation, you had been approved", now i will send you the form that you have to fill and sign out and send my back by fax including a copy of the check with the First and last payment and the $400 document fee. I sent him on 02/16/2011 and next day the total amount was withdrout from my bank account. 


Since that time the problems began. They was kept us in stand by for arroun 3 month (the vendor and m company) and in that time our vendor got the confirmation and then sent us the equipment. 4 motns later the vendor called me and let me know that the leasing company didn't paid they yet and they had to program the equipment pick up. At the end i had to apply with another company called Direct Capital, and this new leasing company approve me the purchase last 07/12/2011. I had been trying to reach Mr. Steve Peeler by phone and by E-mail but is Misssion Imposible. 


Two weeks ago 07-13-2011 somebody called me from Benchmark company and told me the they can't refund the money back because i signed a contract but i don't undersatand, if they never, never gave me the service due to their fault and i had to get the loan for another different company 5 (five) months later, they just said "I'm sorry but your money is here and you can use it with another loan"

Cobalt Funding and Partners Signs Down From Adjacent Offices

Now .. the Cobalt and Partners Signs have been taken down from the offices adjacent to the Benchmark office .. The Benchmark sign has been down for some time. Don't think for a minute that Marcus Davin is changing anything .. it seeps like he is going into the stealth, boiler room, mode.

Can you imagine what it would be like going to work for him everyday? Know anyone who does? Let me know ... I would like to visit with them.
