Another Complaint about Benchmark .. now Cobalt

Here is a short summary of what happened to me, I will be more than happy to send all copies of emails and other documents that I have concerning this matter if needed.

After receiving emails normally every week, from Benchmark , I decided to reply to one. The representative that I dealt with was , Adam DiCosola, and the first email that I answered was one dated 1/20/2011 . I asked him to put together some funding details for a working capital loan/lease in the amount of 25k to 35k. After about a week, I completed the application and forwarded the required documents at the time. In February, he sent me an email, ( also a telephone call ) explaining the loan details, monthly payments and fees. In March , I asked specific questions concerning this matter, and he answered them in an email. I then sent the final signed documents with a check ( approximately $ 1600 ) to cover the 1st, last, and fees.

After he received this , he then said there may be additional fees now. He also said more documents are now needed. I supplied everything that was asked of me, all of the additional requests. In April, he now said that the original terms would have to be now changed, since this funding option was no longer available to me . ( ?????) He said that we now had to make it a collaterized loan. Again, I sent in more documents asked of me. I knew that something was wrong , and refused to send in any additional monies for fees etc.

In May, Mr. DiCosola said that all of his underwriters denied the funding. He then said there may be other options. I said to cancel all of this, and refund to me the money that was promised in our discussions. He said it would probably take a month but I would be receiving a check for my initial down payment minus their small fees.

Since May, I have been told that the accounting department has my file, that most of the employees are on vacation in June and July etc..... every excuse which he could state. I have never received anything back from this company, and now all of my emails and voice messages are being deliberately ignored.

The entire effort is worthwhile because of what happened today. Chris a vendor., was doing some research for his customer. The customer was contemplating a lease from Benchmark.  Chris who is outstanding, Googled Benchmark and it led them to me.  His customer was asked to send $4,000 + for the deal that could be closed by next Wednesday. They needed a faxed copy of the check and signed docs ...today.   

Guess what advice I gave to Chris?  This is an example of excellent customer service!  Makes all effort worthwhile.

Hey Ron, if you can please not post my email address but I'm shocked how Benchmark can still operate. I know for a fact that they have only a couple of lenders who will accept applications from them. We had an employee who left our A+ rated BBB company with 10+ years in business, over 2 dozen lending sources, and a solid reputation to go work for Benchmark. He just quit there because of a commission dispute and is now looking for work again. I just can't imagine cold calling businesses and trying to get them to finance with  Benchmark. Sure some business owners are too busy to do a little background search and some are very trusting but the vast majority of business owners will do their due diligence. Benchmark employees must feel some guilt going into work every day. It has to be hard trying to earn a living when your employer's reputation is the worst in the industry plus with only a few lending sources. Many finance companies in Irvine are hiring experienced reps who are good on the phones. You can earn a living being a good person and not screwing businesses. It's a lot easier getting a customer to do business with you when you're an A+ rated BBB company. I feel bad for Benchmark employees. There's a lot more commission funding a $75,000.00 lease than ripping someone off for $1,000.00 and giving more than half to Marcus. Do the right thing.

Another advance rental complaint on Benchmark

 I sent my lease application on 02/08/2011 with the whole information in it; including my SSN, my address and company information. Few days later, i got a phone call from Steve Peeler where said "congratulation, you had been approved", now i will send you the form that you have to fill and sign out and send my back by fax including a copy of the check with the First and last payment and the $400 document fee. I sent him on 02/16/2011 and next day the total amount was withdrout from my bank account. 


Since that time the problems began. They was kept us in stand by for arroun 3 month (the vendor and m company) and in that time our vendor got the confirmation and then sent us the equipment. 4 motns later the vendor called me and let me know that the leasing company didn't paid they yet and they had to program the equipment pick up. At the end i had to apply with another company called Direct Capital, and this new leasing company approve me the purchase last 07/12/2011. I had been trying to reach Mr. Steve Peeler by phone and by E-mail but is Misssion Imposible. 


Two weeks ago 07-13-2011 somebody called me from Benchmark company and told me the they can't refund the money back because i signed a contract but i don't undersatand, if they never, never gave me the service due to their fault and i had to get the loan for another different company 5 (five) months later, they just said "I'm sorry but your money is here and you can use it with another loan"

We signed a lease contract agreement for the procurement of a new refrigeration system in which the quoted price was $1176.10 per month. We FAXED over a copy of a check for the first 2 payments in the total amount of $2402.20. The check was electronically deducted from our account on 06/01/2010. We then received a new contract in which the payment had changed to $1279.46 per month. The original contract was breached. We requested a refund of the down payment via many emails and phone calls. On the way to the airport yesterday I received a call from another victim. He faxed a copy of a check for a small amount. The routing number/account number on the faxed check was all these thieves needed to deposit the money.

He was to fax and send a much larger check but before he did, he thought he would Google Benchmark. Well if you have Googled Benchmark lately you know the rest of the story.

This man was refered to Benchmark by a vendor. If you are reading this then you probably have been refered or ripped off. Tell vendors to Google Benchmark, or check with the BBB.

Torch Awards Presented

Last night Kennon Products was among the 12 companies honored by the
Better Business Bureau of Northern Colorado and Wyoming at their
annual Torch Awards Dinner.  Torch Awards are given to businesses that
best exemplify the highest standards of business ethics in how they
interact with customers, employees and their community.  There were
about 500 people in attendance and it truly was a well produced event
with a variety of entertainers, video production, and an excellent
reception and dinner.

Another Benchmark Rip Off -

I lost 813.00 first and last months payment to so called benchmark financial.  I own a small business in Round Rock Texas and really couldn't afford to lose any money.  Basically what happened was they kept asking for more info that they already had asked for. 

Then asking me to provide things I didn't have like verification of an old LLC that I had already sold.  When I Couldn't provide the paperwork that basically didn't exist they said I couldn't have any money back.  I spoke with Craig Loveless his boss was Jason bernal then there was Marcus Davin but mysteriously he never came to the phone. 

This happened back in september but recently they sent me an advertisement about there leasing services.  When is this company going to go out of business?

Familiar Story

on around sept 2009 i was looking at a tow truck to buy to replace my old one. i called benchmark financial group, they aproved a lease at around 9.8% i signed the agreement and sent them $3800. they asked if i could fax them a copy of check to get things going,.I did.

They cashed the faxed copy before they recived the mailed one. weeks went by , and i kept calling telling them i had a class included w the tow truck purchase i had to go to. they called said that they couldn't get in house finanacing and would use a outside company.

More time went by (I missed Class ) and they came back with a intrest of 29% i told them that was unaceptable and that i wanted my money back. I called the national equipment finance ass. and they reviewed the case and found in my favor. they notified benchmark and told them to refund me my money or they would have there mebership revoked (benchmark didn't).I reported and filed a complaint with the cal. attorney General and still to this day have not recived a refund.

Calm Down - State the Facts

I get many emails each day about Marcus Davin and Benchmark.  Many are simply copies of emails to Benchmark employees.  The threads are too long to post.  If you would simply take a deep breath .. and compose a paragraph or two stating the facts.  What happened to you?  How did Marcus and Benchmark rip you off?

If there are other representatives from Benchmark involved tell us about them too.

Keep the emotion out of it.  I know that you are angry. We are all angry.  Right now we need people who can calm down and state the facts clearly.

Here's the deal

A pattern emerges.  Marcus asks for deposits and never returns them when he can not find a lender to finance the deal.  If it is an out of state customer, he calculates the risk that they will take him to court.  Unlikely for the small sums of money that he steals.  Often $2,000 or less.   He could care less about the Better Business Bureau of www.leasingnews.org he simply ignores them. 

He offers a "Credit Repair Service" that is another one of his rip offs.  According to former employees there is no one in his organization that does credit repair.  He collects the money .. for credit repair just like he collects the money for insurance ... but provides nothing in return.

Marcus Sueing Me

I keep getting this question ... aren't you affraid of Marcus sueing you?

No.  The last pace that Marcus wants to be is a place where people have handcuffs and badges. 

Not only that, I am stating the truth!  ..Slander is fasle witness .. I am amazed by the number of people who Marcus Davin has stole from. 

 My dream is that Marcus will will sue me in a Wyoming court.  And all of you show up.  I will host a big party ..

Or sometimes I have this dream that we are all together for a "conviction party" at Disneyland.

I get this question from employees who used to work for him... aren't you afraid of him be cause he has all of this money. 

Yes, he has a wonderful house in a gated community in Newport Beach and his wife doesn't even know that he is a crook.  But no .. it is money that he has taken from victims .. small businesses .. and I will fight to my last breath to bring him to justice!

Criminal

There are two things that you need to do.  If you have been burned by Marcus Davin.  Take him court an plan to show up.   http://www.occourts.org/directory/criminal/  does not matter one hoot whether you get more money then you spend getting to court.   Go to Disneyland.  It is right next door.

If you get a judgment .. which you will, then send me a copy.  I am collecting all of them.  If you have a story, and do not wish to go to court, then write a one page summary, sign it, and have it notarized . Send it to me,

You see, this is no longer a civil matter.  It is a criminal matter.  Federal ... yes. 

I do not care how much money this man is a theif ... . and whether we get it back what we have lost, ...  I want to see him in prison.

Also to those currently work for Marcus ... leave, and come over to our side.  You have families .. and you don't want to restrict their visitations to Saturdays.

Many victims have told me that they are afraid of Marcus...  I am not .. I believe in America's justice system .. but I need your help.

Benchmark Fraud - Welcome

I received a call from Marcus Davin today.  He seemed to want to retry the case.  Superior Court, Orange County, CA issued a judgement against Benchmark on Wednesday.  I think that he really believes in what he says .. some may call one like that a "pathological liar"

He threw around a few threats.  Liable and Slander are only an issue if it ruins someones reputation or ability to do business. We all know that there is nothing more that can be said to ruin Marcus Davin's reputation.

I told him that I didn't think that it was a good idea to hang around where justice is served.  Even though he been to court so many times that they should have a parking space reserved with his name on it.  A choir boy he is not. 

I would go to court!  And while I was at it I would organize a Benchmark Fraud reunion at Disneyland!  It is an awesome place and it is only a few miles from the courthouse.
